1. Applicability
These general terms and conditions apply to all offers, orders, and agreements made through the website guitarbuddy.nl. By placing an order, the customer accepts these terms and conditions.
2. Products and Offers
- All products offered on GuitarBuddy are clearly described and presented. We strive to ensure that the information regarding the products (such as descriptions, specifications, and images) is accurate. However, minor deviations in color or details may occur.
- Offers on the website are non-binding and may be subject to change.
- We reserve the right to modify or discontinue any product at any time without prior notice.
3. Prices
- All prices listed on GuitarBuddy are in Euros (€) and include 21% VAT unless stated otherwise.
- Shipping costs are not included in the product prices and will be calculated separately during the checkout process.
- We reserve the right to change prices at any time, but the price stated at the time of your order will apply.
4. Payment
We offer the following payment methods:
- iDEAL (for customers within the Netherlands)
- Credit Cards (Visa, Mastercard, etc.)
- Bank Transfer
Payments must be made in full before we ship any products. If a payment is not received or rejected by the payment provider, GuitarBuddy reserves the right to cancel the order.
5. Shipping and Delivery
- GuitarBuddy delivers within the Netherlands and internationally, depending on the shipping options available.
- Delivery times vary depending on the product’s availability and the destination. We aim to ship orders within 1–3 working days after receipt of payment, unless otherwise stated.
- If delivery is delayed or if an order cannot be fulfilled due to a product being unavailable, we will notify you as soon as possible. You may choose to cancel the order or wait for the product to become available.
- Delivery is deemed complete when the product is delivered to the address provided by the customer during checkout.
6. Right of Withdrawal
As a customer, you have the right to withdraw from your purchase within 14 days of receiving the product, without providing a reason. This right of withdrawal is subject to the following conditions:
- The withdrawal period expires 14 days after the date you or a third party (other than the carrier) takes possession of the product.
- To exercise your right of withdrawal, you must notify us via email (hello@guitarbuddy.nl) within the 14-day period.
Return Process:
- Products must be returned in their original packaging and condition.
- The costs of return shipping are the responsibility of the customer.
- Upon receipt of the returned product, we will inspect it and refund the purchase amount, excluding shipping costs, within 14 days. Refunds will be issued using the same payment method used for the initial purchase.
7. Exclusions from Right of Withdrawal
The right of withdrawal does not apply to:
- Custom-made products or products that are personalized at the customer’s request.
- Products that, due to their nature, cannot be returned (e.g., opened software or hygiene products).
8. Warranty and Complaints
We strive to deliver high-quality products. If there is an issue with your order, we offer the following warranty and complaint procedures:
- Warranty: Products purchased from GuitarBuddy are covered by a standard warranty of 6 months, starting from the delivery date. This warranty covers defects in materials or workmanship under normal use. The warranty does not cover damage caused by improper use or wear and tear.
- Complaints: If you receive a defective or incorrect product, please contact us at hello@guitarbuddy.nl as soon as possible. Provide your order number and details of the issue. We will offer a suitable solution, which may include replacement, repair, or refund.
9. Liability
- GuitarBuddy is not liable for any indirect, consequential, or incidental damages resulting from the use or inability to use our products or website.
- We are only liable for direct damages that are the result of intentional misconduct or gross negligence on our part.
10. Force Majeure
In the event of force majeure, GuitarBuddy reserves the right to suspend or cancel the performance of the contract. Force majeure includes but is not limited to strikes, fires, government measures, and any other situation beyond our control.
11. Intellectual Property
All content on guitarbuddy.nl, including but not limited to text, images, logos, and designs, is the intellectual property of GuitarBuddy or its licensors. Unauthorized use of any content is prohibited without prior written permission.
12. Applicable Law and Dispute Resolution
- These terms and conditions are governed by Dutch law.
- Any disputes arising from these terms or the use of our website and services will be resolved in accordance with Dutch law and will be subject to the exclusive jurisdiction of the courts in The Netherlands.
13. Amendments to These Terms
We reserve the right to update or amend these terms and conditions at any time. The latest version will always be available on our website. By continuing to use our website and services after any changes, you agree to be bound by the updated terms.
